Terms and Conditions

RM Chauffeurs Limited T/A Chauffeurly referred to herein after as (“Chauffeurly”) 

Chauffeurly enables its users to book Chauffeur driven services online, as well as through the applications for mobile devices. Chauffeurly only by arrangement arranges chauffeur driven services with the chauffeur transport provider as an agent and does not carry out the service direct.

These Terms and Conditions are part of every agreement between its users with the arrangement of a chauffeur services by Chauffeurly. They also describe the chauffeur services which are offered through the direct entitlement created by Chauffeurly between its users and the chauffeur transport provider.

Any deviations from the terms and conditions will be rejected, unless agreed in writing from management of Chauffeurly.

Chauffeurly provides chauffeur driven services online or by telephone - and  arranges for the users entitlement to carriage over a chauffeur transport provider totally separate of Chauffeurly.

Chauffeurly organises the chauffeur driven services with the chauffeur transport provider which provides the user with entitlement to carriage over the chauffeur transport provider. Therefor customers are entitled to demand chauffeur driven services and claims direct from the chauffeur transport provider.

Chauffeurly is not a transport company, only an arranger. Chauffeurly fees are made up of administration fees and the advance payment to the chauffeur transport provider.

When submitting a booking online or by telephone the user makes an agreement arrangement. This agreement is the arrangement of chauffeur driven services to meet the user’s request. Upon the user booking, Chauffeurly will send the user confirmation for the chauffeur driven services required.

1 - BOOKING

1.1 – The user must allow sufficient time when booking to allow for the travel times required by your airline, cruise ship or train, and for any delays caused by traffic conditions.  Chauffeurly or the chauffeur transport provider shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

1.2 – You must order a suitable car size for the number of passengers and luggage. The price given in the booking confirmation includes the number of pieces of luggage specified in the booking. If not stated when booking an additional surcharge could be applied. There is no guarantee to carry excessive amounts of luggage, the chauffeur transport provider can refuse the ride if the vehicle booked is not suitable. It is the responsibility of the user to book the correct class of vehicle. Please note that a child, no matter what age, counts as one passenger.

1.3– Chauffeurly reserve the right to refuse any booking for any reason they deem necessary. 

2 - PAYMENT AND DEPOSITS

2.1 – All prices are inclusive of VAT charged at the current rate of 20%.

2.2 – Our payment terms for regular bookings are: All payments are due in full before any journey commences. 

2.3 – For wedding bookings 25% deposit is required with the remaining balance due 14 days prior to the ceremony date.

2.4 – Any deviations to the original booking price, such as additional waiting time, additional hours overbooked, car parking additional stops and address changes will automatically be charged from the credit / debit card that you provided upon booking.

2.5 – The charge on your credit / debit card statement will be shown as Chauffeurly.

3 - CANCELLATION AND REFUNDS

3.1 – If a booking is cancelled by the Customer within 24 hours of the hire commencing 50% of all monies paid will be non-refundable.

3.2 – If a booking is cancelled by the Customer within 12 hours of the hire commencing, 100% of all monies paid will be non-refundable.

3.3 – If a wedding booking is cancelled within 1 month of the booked date, then the deposit will be non-refundable. If a wedding booking is cancelled within two weeks from the booked date, then the full hire amount will still be charged to the Customer.

3.4 – If multiple vehicle bookings are cancelled by the Customer for any corporate, business or event within 5 days from the start of the period of hire, 100% of all monies paid will be non-refundable.

3.5 – If the Customer does not appear at the time and place designated as the pickup point, all monies paid will be non-refundable. The user is allowed 1 hour free waiting for airport transfers from when the aircraft lands, and 15 minutes free waiting for all other transfers.

3.6 – Cancellations for hourly bookings. If a booking is cancelled by the Customer within 12 hours of the hire commencing, 100% of all monies paid will be non-refundable.

4 - TERMS AND CONDITIONS

4.1 – Chauffeurly request a minimum of 24 hours’ notice for any online bookings. If you would like to book a vehicle with less than 24 hours’ notice, then please call our booking coordinators on 0800 030 6854.

4.2 – Every effort will be made by Chauffeurly to ensure that the chauffeur transport provider vehicle arrives on time. However, you will understand that we cannot accept responsibility for delays caused by circumstance out of their control.

4.3 – Your chauffeur transport provider Chauffeur will drive at safe and sensible speeds in accordance with road conditions, traffic and the legal speed limits.

4.4 – Users are responsible for any damage they cause to the chauffeur transport providers interior and or exterior of a vehicle and will be billed accordingly for any repair or valeting required in order to reinstate a vehicle to working order – as well as any subsequent loss of earnings for the chauffeur transport provider for the consequence of their vehicle being off the road.

4.5 – By supplying your email address you permit Chauffeurly to contact you via email, we promise never to supply your email or details to any third party.

4.6 – We reserve the right to change your Vehicle or chauffeur transport provider Chauffeur at any time if necessary.

4.7 – Your chauffeur transport Chauffeur will travel by the most appropriate route on the day in accordance to traffic and weather conditions, unless instructed otherwise by the Customer at the time of booking.

4.8 – All chauffeur transport providers vehicles are fully insured and licenced with the relevant authorities. Customer’s property is carried entirely at their own risk and Chauffeurly shall not be held responsible or liable for any loss or damage to such property.

4.9 – Your chauffeur transport Chauffeur will check the vehicle for any personal items left in the vehicle. The chauffeur transport provider keep a lost property book at their office and will endeavour to return any lost goods found to the user within 72 hours.

4.10 – All chauffeur transfer providers operate a strict no-smoking, vaping or eating policy in its vehicles.

4.11 – When booking online, bookings for Christmas Day, Boxing Day and New Year’s Day attract a 100% surcharge. All other bank holidays will attract a 25% surcharge.

4.12 – The chauffeur transport provider shall use all reasonable endeavours to get you to your destination on time but shall not be liable for any loss due to delays caused by road or traffic conditions beyond its control on the journey.  Under no circumstances shall Chauffeurly or the chauffeur transport provider be liable (in contract, tort or otherwise) for any loss of profits, business or for any indirect or consequential loss whatever.

4.13 – Chauffeurly shall be entitled to cancel all services and provide refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control. If the car breaks down during your journey Chauffeurly will endeavour to arrange an alternative car to complete the journey as soon as practicable.

4.14 – The user shall indemnify Chauffeurly against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.

4.15 – Neither party excludes or limits its liability for death or personal injury caused by negligence, or for wilful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law. 

5 - TERMINATION

5.1 – Your chauffeur transport provider Chauffeur has the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat either to the themselves or the vehicle or any other passengers. Your fair will not be refunded.

6 - MISCELLANEOUS

6.1 – The chauffeur transport provider may not subcontract its obligations under this Agreement.  

6.2 – Chauffeurly may change these terms and conditions at any time by posting changes online.  Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.

6.3 – Chauffeurly shall store, process and use all information regarding your personal details in accordance with the requirements of the Data Protection Act 1998.

6.4 – This Agreement and any accompanying quotation represents the entire agreement between the user and Chauffeurly in relation to its subject matter.  If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.

6.5 – Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.

7 - DISPUTES

7.1 – This Agreement shall be construed in accordance with English law, the user and Chauffeurly each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this Agreement.

8 - CONVEYING OF CHILDREN AND ANIMALS.

8.1 – For Health and Safety reasons Chauffeurly are unable to provide any form of child seat. If you require a child seat for your journey it would be the child’s parent/carers responsibility to provide one and to fit the seat in the vehicle and to secure the child. If you are booking a return journey and have your own child seat, the driver who carries out your booking will store your child seat for the return journey, please note that the installation of the child seat must be carried out by you.

8.2 – The chauffeur transport provided reserves the right to refuse the carriage of animals which are not agreed to and not contained in a suitable transport cage. This excludes all assistance dogs. In some circumstances CTP may have an exemption certificate to carry animals. Please give clear instructions when booking to insure a suitable chauffeur transport provider is partnered.

9 - Upgrades

9.1 - The user can choose from different vehicle classes when booking. These are Business Class, Business MPV, or First Class. On occasions the chauffeur transport provider may upgrade from the vehicle class booked to a higher class vehicle at no addition cost to the user.

9.2-The vehicle images shown on the booking form are for illustrative purposes only and to show the different classes available. These vehicles will be of the same classes or similar manufactures vehicles, and are not connected with any right to a particular vehicle model for the booking.
